Work-related spinal cord injuries covered under workers’ comp

On Behalf of Ellis Law Offices LLP | Jan 25, 2017 | Workers' Compensation

In Massachusetts and elsewhere, work-related spinal cord injuries occur quite frequently. Some individuals who suffer such injuries may only require rest and pain medication to help them recover, but there are those who may require extensive medical treatments and/or life-long care.

Treating severe cases of these type of injuries is neither easy or cheap. This can take a great toll on the injured individual and his or her family. If you have suffered a spinal cord injury while in the workplace, you may be eligible to access workers’ comp benefits, which could help cover the cost of any care you may need — whether temporary or permanent — as well as numerous other economic losses you may experience.

Spinal cord injury symptoms

A significant blow to the back is generally what causes a spinal cord injury. Common causes include falls, auto accidents or being hit by heavy equipment or machinery — among various others. An injury to the spine can damage vertebrae, discs and nerves, causing some or all of the following symptoms:

  • Pain
  • Weakness
  • Numbness or tingling in extremities
  • Loss of movement
  • Loss of sensation
  • Partial or full paralysis

Possible treatments

Before proceeding with treatment options, medical providers will have to determine the severity of your injuries typically by testing your sensory function in a physical exam. They may also order imaging tests, such as X-rays, CT scans or MRI’s, in order to see the injury up close.

After injury severity is determined, you may receive suggestions for various treatments, including the following:

  • Medications
  • Surgery
  • Electrical stimulation
  • Physical therapy

Counseling is also commonplace for victims of these injuries, as there can also be many emotional challenges to overcome.

How can workers’ compensation coverage apply to my injury?

Spinal cord injuries can affect one’s personal and professional life, either temporarily or permanently. If you have suffered such injuries in a work-related incident, you may utilize workers’ comp benefits to help with your care, recovery and financial losses. If necessary, these benefits can also cover job training if your injuries leave you unable to return to your current position.

Sadly, it is not uncommon for injured employees in Massachusetts and elsewhere to find it difficult to achieve full benefits for their losses. An experienced workers’ compensation attorney can help you fight insurance companies for the benefits you are legally entitled to receive. If

applicable, your legal counsel can assist you in filing other civil claims against the individual or individuals believed responsible for your injuries in an effort to seek further compensation.
