Man charged in fatal pedestrian accident in Worcester

On Behalf of Ellis Law Offices LLP | Dec 30, 2014 | Car Accidents

Whether they are traveling on the sidewalks, traveling on a crosswalk or walking in a parking lot to a vehicle, store or business, many Massachusetts residents are pedestrians at some point during the day. Even if an individual is only walking near moving vehicles for a short period of time, both pedestrians and drivers should be aware of each other to avoid a collision.

Authorities in Worcester recently responded to a fatal pedestrian accident. According to reports, a 60-year-old man was struck by a truck at the intersection of Grafton Street and Wall Street. The driver of the vehicle fled the scene of the accident, but after reviewing a surveillance video, police identified the 51-year-old driver of the Mack truck that struck the man while in the crosswalk.

The stuck man was transported to the hospital where he was later pronounced dead. Investigation is still ongoing and the driver is cooperating with investigators. At this time, police have charged the driver with motor vehicle homicide, operating to endanger and failure to yield to a pedestrian in a crosswalk.

In addition to these criminal charges, the driver could face other consequences such as a civil action. The loved one of the deceased pedestrian could file a wrongful death claim. Family member could recover compensation, and the monetary award could be used to cover expenses such as medical bills, funeral costs, lost wages and other related damages.

A fatal accident is often a difficult event to cope with. Moreover, even if family members seek to file a suit for their losses and damages, they may not fully understand their options or how to navigate the process. Seeking advice about the legal remedies available could help ensure loved ones take appropriate action and protect their rights throughout the process.
