Know the limits on insurance coverage in motorcycle accidents

We've been discussing one particular theme over the past few weeks here on our Worcester personal injury law blog. We looked at a motorcycle accident that resulted in a head injury, and we discussed some of the medical expenses that a motorcycle accident victim might expect to incur with such an injury. Today we'll round out this topic with a few notes on what legal rights victims can exercise in an attempt to recover compensation for these and other losses.

Massachusetts motorcyclists might assume that their personal injury protection policy will cover them in the event of a motorcycle collision. Many of them find out too late that this is not the case. The only way an insurance policy would cover any of a cyclist's medical expenses is if it includes Medpay. This is additional, optional coverage that one must pay for above and beyond one's regular premiums. If you are lying in a hospital bed and realizing that your policy does not include Medpay, it may be time to consult with a legal professional.

An attorney can help because without Medpay, you would need to look at pursuing a personal injury claim against the driver who caused your injuries, unless you want to be on the hook for the kinds of medical bills we reviewed in our last blog post. A legal professional will recognize that one's main priority right now should not be struggling with insurance companies, police reports and personal finances. When victims have suffered a head injury, broken bones, spinal cord injury or similar trauma, they will need rest and a calm environment as you begin to recover. A lawyer can manage the legal issues while the victim focuses on his or her health.

Accident victims may be getting the message that, because they did not opt for Medpay, it's their loss; tough luck. Our motorcycle accidents page should help victims understand that, on the contrary, a legal professional can help hold a negligent driver liable for the damages a person has suffered. And while this information is general in nature only and not intended as specific legal advice, it's important to recognize that accident victims do have legal rights in these situations.
